What documentation is required?

Australia uses a ‘No Fault’ system, meaning you do not need to have valid proof of reason in order to follow through on a separation.

There are, however, some requirements needed for an official filing to proceed.

These include:

  • Proof that you: 

  • are an Australian citizen; or

  • are lawfully present in Australia and intend to continue living in Australia (including proof that you have been living in Australia for the past 12 months);

  • evidence of marriage (i.e., a valid marriage certificate);

  • there being no reasonable likelihood of the relationship being recommenced or cohabitation resuming;

  • there has been a 12-month and 1 day continual period where yourself and your former partner have been separated and living apart; and

  • if you and your former partner have been married for less than 2 years, proof that you have undertaken marriage counselling via a counselling certificate (for referrals, please contact our team).

If these conditions are met, proceedings can be applied via the Court’s e-filing CommCourt portal.

E-filing requires the following:

  • a copy of your original marriage certificate (if unavailable, we can obtain a certified copy from births deaths and marriages); and

  • funds available for the filing fee (we will provide details of this fee once engaged, as the amount may vary).

Further, depending on circumstances, the following may also be required:

  • in circumstances where you are filing for divorce on your own (i.e., without the co-operation of your partner), the application will need to be accompanied by an Affidavit of Service by Hand and an Acknowledgement of Service evidencing that your former partner has been personally served;

  • if you have been unable to sustain a continual period of 12-months separation, or are separated but living together, an Affidavit providing further evidence to show that you have separated will be required; and

  • in circumstances where the marriage certificate is in another language than English, a certified copy of a certified translation by a NAATI accredited translator will be required.
